March 20th, 2008 at 11:25 amThere are no good guys in this story and the circumstances are very muddled. The kids were punks and the guy is a lying nut. He first started saying he shot the kid by accident, then started saying he feared for his life. What I think happened is they called him a nigger and he lost it. If I shot everyone who called me a honky they’d be digging mass graves.
They weren’t even on his property when it happened. He went over to them. He should’ve said, “I called the cops. If you’re still here when they get here, I’ll have you all arrested.” Instead he started waving his gun in their faces and got into a screaming match that ended in blood.
The whole thing started because some sick fuck falsely claimed the guy’s son was saying he was going to rape a girl the kids knew. Being young, drunk, and stupid, they went looking for him. I can understand that. But what they did was wrong.
The guy looks out his window and sees a mob looking to do his son harm, so he grabbed a gun and confronted them. I can understand that, too, but he did the wrong thing as well.
I wouldn’t convict him of murder, but he sure as shit shouldn’t have walked away scott-free. Manslaughter sounds about right, but he’ll only wind up serving two years or less. I’d have given him at least five. The judge was too lenient.

However the black Father with the illegally owned gun and ammunition (if true) is a felony, not to mention the murder. He shot a kids face off, you give a verbal warning (and perhaps fire off a round or two) and then maybe you’re in the rights to shoot someone who is attempting to attack you (verbal threats don’t count).

1 Every firearm is loaded, regardless of what you might think.
2 Do not touch a firearm unless you have a valid reason.

3 Do not point a firearm at anyone (thing) you do not intend to kill.
4 You are the ultimate safety device, mechanisms can fail.

Called the police and hunkered down, watching from behind a locked door.
That he went out and confronted 10 kids who were on public property, the street, or on a public easement, the sidewalk, shows piss-poor judgment.
10-1, close quarters is not good odds, even if you do have the only gun.
If he headshot the kid, that, to me, shows intent (see rule #3).
Ignorance is no excuse, but I’m a prick when it comes to gun safety and responsibility.

The Judge determines what the sentence is within a range - apparently the statutory range for manslaughter has a low end (2 years) - the system gives the judge a lot of leeway in determining sentencing.
I think he deserved zero years. I hate to say it, but if it had been a gang of black kids out in that neighborhood attacking a white guy, they probably wouldn’t have arrested him.
What I’m bothered by is the way cases like this erode gun rights - I would rather have seen this case stand for a stronger precedent that you can defend one’s property with a firearm. In light of the recent debate about the second amendment, I wish I could have held up his acquittal as a reaffirmance of “gun rights”. Instead he was convicted.

For anyone who thinks, “A white guy shooting a black kid woulda walked,” let me tell you a little story.
I know an Italian guy who saw his father and brother-in-law getting beaten to death by a black guy with a baseball bat. He was an off-duty cop, and had his gun on him. He shot the guy, as he was raising the bat for another swing, killing him. He probably saved the lives of his father and brother-in-law.
He was convicted of murder and sentenced to TWENTY YEARS.
State-sponsored discrimination is alive and well in America.

I would defend my family with my god-given right to bear firearms. I don’t think this guy did anything different.
I don’t understand these people talking about “warning shots” - firing a warning shot could be dangerous (hit someone a few blocks away intentionally). Those of us familiar with basic firearm safety know that you only fire at something you intend to hit.
Cases like this will be used as an excuse to further strip of of our gun rights.
