Rape Justice? Or No? You Decide… With Video
Last week I came across a video that truly disturbed me. That’s saying a lot because I have seen every freaking horrific accident, beheading, and execution video ever posted at LiveLeak, and the old Ogrish before LiveLeak was born (hmmm, maybe I need to see a shrink)…
Anyway, it was the video of the young teenage girl pleading for justice because she claimed she had been raped but the DA wouldn’t prosecute etc etc…remember that one? Watch it here.
So Megyn Kelly did a “Kelly’s Court” on it today…I want to hear what you all think…

Look the girl clearly wanted revenge, but bottom line the law states having sex with anyone under the age of 15 is statutory rape. The guy should have waited the 30 days till she was legal. Then this would be a non issue, he didn’t and he should be held accountable. What kind of message does this send to other would be offender with more sinister motives. I feel for the guy, but he should have kept it in his pants another 30 days. Sorry the law is the law.
May 21st, 2008 at 8:23 amWhen I first saw this, I wasn’t sure whether or not she was telling the truth. After some internet snooping, I realized this was no joke, this girl was in pain.
She may have been pissed at the guy for hiding his ‘real’ girlfriend or because he refused to buy her a cheeseburger the night before. Why she decided to press forward with this after they broke up, only she really knows.
The key here is that he had sex with her while she was 15 years old. She cannot legally grant consent and that makes this a slam dunk rape conviction. They should have nailed that guys balls to a wall.
If I were her father, she’d be grounded till she was old and gray. The guys head would be a trophy on my den wall.

I guess now, 1 month before you turn 16 you can get a driver’s license, 1 month before you turn 18 you can buy cigarettes, 1 month before you turn 21 you can buy a pistol and so on, right? Yeah, sure. Why bother setting certain ages if they don’t mean anything?

May 21st, 2008 at 8:35 amAll other considerations aside, the prosecutor must prove - independent of the girl’s statement - whether sex occurred when the girl said it did. Since time has passed and she’s now attained legal age status, a medical exam probably wouldn’t yield any useful evidence. What’s left is the possibility of a corroborating witness or the suspect’s admission that sex occurred when he knew or should have known she was underage. Lacking that, it’d be a tough case to prosecute successfully.
May 21st, 2008 at 8:43 amI’m guessing the reason the case wasn’t taken up is because there must be a lack of hard evidence available to back up the claim that sex first happened 30 days before she turned 16. If that proof does not exist, this chick would have no chance in court.
I’m not defending the dude here, he’s a big time creep. A good rule to follow in life is: If you aren’t in high school, don’t get involved with high school kids. It’s really that simple.

May 21st, 2008 at 8:54 amThe prosecutor’s job is to represent the state, not the victim. In this case the victim could not consent by law because she was too young to make an informed decision. Her inability to make the informed decision is obvious when listening to her. Again, the state has the case against the 23 year old predator loser creep. The predator will do it again, to other immature girls capable of easy manipulation, because he’s just been told he can. The law in the county where this prosecutor works has just been changed from 16 years old to 15 years and 11 months. Or maybe the prosecutor decided that the people he represents really don’t want criminals prosecuted if their victims were easily manipulated girls incapable of consent but close to it.
